BLU ACADEMY is committed to protecting the privacy of visitors to our website, prospective students, enrolled students, faculty, collaborators and other stakeholders if any. We are engaged in providing professional education and training in audio engineering and music production. In the course of operating our website and delivering our academic and studio services, we collect and process certain personal data of website visitors, prospective students, enrolled students, faculty members, collaborators and other individuals who interact with us.

The Student agrees to pay the course fees as prescribed by the Firm. Unless expressly stated in a separate written Refund Policy issued by the Firm, all fees once paid shall be non-refundable.
In the event of non-payment or delayed payment, the Firm reserves the right to suspend access to classes, studio facilities, and academic services without prejudice to its other legal remedies.
BLU ACADEMY collects and processes personal data for legitimate and lawful purposes in connection with the operation of its website, delivery of educational services, and administration of its academic programs.

The Firm shall collect and process personal data of the Student in accordance with the Information Technology Act, 2000, the SPDI Rules, 2011, and the Digital Personal Data Protection Act, 2023.
The Student acknowledges and consents that the Firm may collect personal identification information, academic records, audio and video recordings, studio session files, CCTV footage, payment transaction references, and technical metadata strictly for lawful academic, administrative, regulatory, and security purposes.
The Firm shall implement reasonable security practices and procedures to safeguard such data. However, the Student acknowledges that no digital system is completely secure and agrees that the Firm shall not be liable for data breaches arising from events beyond reasonable control, including cyberattacks, power failures, third-party platform failures, or force majeure events.
To the maximum extent permitted by law, the aggregate liability of the Firm arising from data processing shall not exceed the total course fees paid by the Student.
BLU ACADEMY processes personal data only where there is a lawful basis to do so and in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023. The Firm may process personal data based on one or more lawful grounds depending on the nature of the interaction with the website or services.

The Student shall not reproduce, distribute, commercially exploit, or otherwise misuse any course material, studio recordings, faculty content, or institutional intellectual property without prior written consent of the Firm.
Any unauthorized use shall constitute material breach of this Agreement and may invite legal action.
BLU ACADEMY’s website may use cookies and similar tracking technologies to enhance the overall user experience and improve the functionality and performance of the website. BLU ACADEMY maintains professional studio equipment and related infrastructure for educational and training purposes. Users of such facilities are expected to follow the operational guidelines and instructions provided by instructors or authorized staff.
Where any damage to equipment, studio property, or institutional infrastructure occurs as a result of negligence, misuse, or intentional misconduct, BLU ACADEMY reserves the right to seek appropriate compensation for repair, restoration, or replacement of such property in accordance with applicable law and institutional policies.
The presence of CCTV surveillance within the premises may also extend to studio areas for safety and security purposes, subject to applicable legal requirements.

12.1 INDEMNITY
The Student hereby irrevocably agrees to indemnify, defend, and hold harmless the Firm, its partners, employees, instructors, contractors, representatives, and affiliates from and against any and all claims, actions, proceedings, losses, damages, liabilities, penalties, fines, costs, and expenses, including reasonable legal fees and arbitration costs, arising out of or relating to:
(i) breach of any provision of this Agreement;
(ii) violation of applicable law;
(iii) infringement of third-party intellectual property rights;
(iv) negligence or willful misconduct;
(v) damage to studio equipment or premises;
(vi) unauthorized recording, reproduction, or dissemination of content;
(vii) third-party claims arising from collaborative works or projects; or
(viii) misuse of institutional digital systems.
This indemnity obligation shall survive termination or completion of enrollment and shall remain enforceable to the fullest extent permitted under applicable law.
12.2 FORCE MAJEURE
The Firm shall not be liable for any delay or failure in performance caused by events beyond reasonable control, including but not limited to natural disasters, governmental actions, epidemics, cyberattacks, power outages, or platform shutdowns.
12.3 DISPUTE RESOLUTION
The Parties agree to first attempt to resolve any dispute arising out of or relating to this Agreement through amicable negotiations.
If the dispute remains unresolved, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai, Tamil Nadu. The proceedings shall be conducted in English by a sole arbitrator appointed in accordance with the Act.
The arbitral award shall be final and binding upon the Parties.
Courts at Chennai shall have exclusive jurisdiction for the purpose of enforcement of the arbitral award.
BLU ACADEMY recognizes the importance of protecting the privacy and personal data of children. In accordance with the provisions of the Digital Personal Data Protection Act, 2023, we do not knowingly collect, process, or store personal data relating to individuals under the age of eighteen (18) years without obtaining verifiable consent from a parent or lawful guardian.
Where our services involve individuals below the age of eighteen, such personal data shall only be processed upon obtaining appropriate consent from the child’s parent or legal guardian, and solely for lawful academic, administrative, or educational purposes related to the services offered by BLU ACADEMY.
If we become aware that personal data belonging to a child has been collected without the necessary parental or guardian consent, we will take reasonable steps to delete or restrict the processing of such information in accordance with applicable legal requirements.
