This Agreement sets forth the terms and conditions governing the Student’s enrollment in the academic programs conducted by the Firm, including but not limited to course participation, studio usage, intellectual property, privacy, indemnity, limitation of liability and dispute resolution.

BLU ACADEMY is committed to protecting the privacy of visitors to our website, prospective students, enrolled students, faculty, collaborators and other stakeholders if any. We are engaged in providing professional education and training in audio engineering and music production. In the course of operating our website and delivering our academic and studio services, we collect and process certain personal data of website visitors, prospective students, enrolled students, faculty members, collaborators and other individuals who interact with us.

BLU ACADEMY is committed to ensuring that personal data is handled in a lawful, fair, transparent and secure manner. This Privacy Policy outlines how we collect, use, store, disclose and protect personal data through our website, online platforms, physical premises and related services in compliance with:

2.1. Enrolment and admission

Enrollment in courses or programs offered by BLU ACADEMY shall be considered confirmed only upon receipt of the prescribed course fees and completion of the required registration or admission documentation as specified by the Firm from time to time.

Individuals enrolling in courses offered by BLU ACADEMY are expected to comply with the academic policies, schedules, safety requirements, studio protocols, and institutional guidelines applicable to the relevant program. BLU ACADEMY reserves the right to refuse admission, suspend participation, or terminate enrollment where an individual engages in misconduct, violates institutional policies or studio rules, fails to comply with applicable guidelines, or defaults in payment of applicable fees.

3. Information We Collect

As BLU ACADEMY provides training in audio engineering, music production, and studio-based creative disciplines, the Firm may collect and process certain forms of creative content generated during academic activities. This may include audio recordings, video recordings, project files, voice samples, and data relating to studio sessions or coursework created as part of training programs.

3.5 Payment Information

However, the Firm does not store full debit or credit card numbers. Payments are processed through authorized third-party payment gateways that operate in accordance with applicable Reserve Bank of India (RBI) regulations and security standards.

3.6 Fees and payment terms

The Student agrees to pay the course fees as prescribed by the Firm. Unless expressly stated in a separate written Refund Policy issued by the Firm, all fees once paid shall be non-refundable.

In the event of non-payment or delayed payment, the Firm reserves the right to suspend access to classes, studio facilities, and academic services without prejudice to its other legal remedies.

4. Purpose of Data Collection

BLU ACADEMY collects and processes personal data for legitimate and lawful purposes in connection with the operation of its website, delivery of educational services, and administration of its academic programs.

Personal data may be used to respond to enquiries submitted through the website or other communication channels, process applications and admissions to courses offered by the Firm, and facilitate enrollment in academic programs. Such data may also be used for the delivery and administration of courses conducted both online and offline, including the management of class schedules, studio sessions, and related academic activities.

The Firm may process personal data for the purposes of academic evaluation, assessment of coursework, and issuance of certificates or other academic recognitions associated with programs conducted by BLU ACADEMY. BLU ACADEMY does not sell, rent, or trade personal data to third parties for commercial or marketing purposes.

4.1 Privacy and data protection

The Firm shall collect and process personal data of the Student in accordance with the Information Technology Act, 2000, the SPDI Rules, 2011, and the Digital Personal Data Protection Act, 2023.

The Student acknowledges and consents that the Firm may collect personal identification information, academic records, audio and video recordings, studio session files, CCTV footage, payment transaction references, and technical metadata strictly for lawful academic, administrative, regulatory, and security purposes.

The Firm shall implement reasonable security practices and procedures to safeguard such data. However, the Student acknowledges that no digital system is completely secure and agrees that the Firm shall not be liable for data breaches arising from events beyond reasonable control, including cyberattacks, power failures, third-party platform failures, or force majeure events.

To the maximum extent permitted by law, the aggregate liability of the Firm arising from data processing shall not exceed the total course fees paid by the Student.

5. Legal Basis for Processing

BLU ACADEMY processes personal data only where there is a lawful basis to do so and in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023. The Firm may process personal data based on one or more lawful grounds depending on the nature of the interaction with the website or services.

Personal data may be processed where the individual has provided consent for such processing, including when submitting enquiry forms, registering for courses, communicating with the Firm, or otherwise voluntarily providing personal information through the website or related platforms. Individuals retain the right to withdraw such consent at any time, subject to applicable legal requirements and operational limitations.

The Student shall retain ownership of original creative works created during the course, subject to compliance with this Agreement.

The Firm shall have the right to store, archive, and use such works strictly for academic evaluation, record-keeping, and internal training purposes.

The Student shall not reproduce, distribute, commercially exploit, or otherwise misuse any course material, studio recordings, faculty content, or institutional intellectual property without prior written consent of the Firm.

Any unauthorized use shall constitute material breach of this Agreement and may invite legal action.

6. Cookies and Tracking Technologies

BLU ACADEMY’s website may use cookies and similar tracking technologies to enhance the overall user experience and improve the functionality and performance of the website. Cookies are small text files that are stored on a user’s device when visiting a website and are commonly used to enable certain website features, remember user preferences, and collect information about how visitors interact with the website.

8. Data Retention

We retain personal data only for as long as necessary to:

• Resolve disputes
• Enforce agreements

After this period, data may be securely deleted or anonymized.

BLU ACADEMY may record, monitor, or archive certain activities conducted through its services or within its premises for purposes relating to academic quality, operational management, safety, and security.

In connection with the educational and studio-based services provided by the Firm, online classes conducted through digital platforms may be recorded for academic reference, training, and quality assurance purposes. Similarly, studio sessions, workshops, or project work carried out within the facilities of BLU ACADEMY may be recorded or archived where necessary for instructional evaluation, documentation, or internal academic use.

In addition, CCTV surveillance systems may be installed and operated within certain areas of the academy premises for security, safety monitoring, and protection of institutional property.

Such recordings and surveillance data may be retained for legitimate institutional purposes including academic evaluation, operational review, security monitoring, dispute resolution, and compliance with applicable legal obligations. Access to such recordings shall be restricted to authorized personnel of the Firm and shall not be disclosed except where necessary for lawful purposes or as required by applicable law.

9. Studio Usage and Equipment Responsibility

Individuals using BLU ACADEMY’s studio facilities, equipment, instruments, recording systems, or other institutional resources are expected to exercise reasonable care and responsibility while using such facilities.

BLU ACADEMY maintains professional studio equipment and related infrastructure for educational and training purposes. Users of such facilities are expected to follow the operational guidelines and instructions provided by instructors or authorized staff.

Where any damage to equipment, studio property, or institutional infrastructure occurs as a result of negligence, misuse, or intentional misconduct, BLU ACADEMY reserves the right to seek appropriate compensation for repair, restoration, or replacement of such property in accordance with applicable law and institutional policies.

The presence of CCTV surveillance within the premises may also extend to studio areas for safety and security purposes, subject to applicable legal requirements.

10. Disclosure of  Information

BLU ACADEMY may disclose or share personal data collected through its website or services with certain third-party service providers and professional advisors where such disclosure is reasonably necessary for the operation of our services, fulfillment of academic activities, or compliance with applicable legal obligations.

11. Your Rights (Under DPDP Act, 2023)

In accordance with the provisions of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), individuals whose personal data is collected or processed by BLU ACADEMY are entitled to certain rights in relation to their personal data.

12. Limitation Of Liability

To the maximum extent permitted under applicable law:

BLU ACADEMY shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to data processing or website usage.

The aggregate liability of the Firm, if any, shall not exceed the amount paid by the concerned user for services, if applicable.

The Firm shall not be responsible for unauthorized access arising from cyberattacks, third-party system failures, or events beyond reasonable control.

12.1 INDEMNITY

The Student hereby irrevocably agrees to indemnify, defend, and hold harmless the Firm, its partners, employees, instructors, contractors, representatives, and affiliates from and against any and all claims, actions, proceedings, losses, damages, liabilities, penalties, fines, costs, and expenses, including reasonable legal fees and arbitration costs, arising out of or relating to:

(i) breach of any provision of this Agreement;

(ii) violation of applicable law;

(iii) infringement of third-party intellectual property rights;

(iv) negligence or willful misconduct;

(v) damage to studio equipment or premises;

(vi) unauthorized recording, reproduction, or dissemination of content;

(vii) third-party claims arising from collaborative works or projects; or

(viii) misuse of institutional digital systems.

This indemnity obligation shall survive termination or completion of enrollment and shall remain enforceable to the fullest extent permitted under applicable law.

12.2 FORCE MAJEURE

The Firm shall not be liable for any delay or failure in performance caused by events beyond reasonable control, including but not limited to natural disasters, governmental actions, epidemics, cyberattacks, power outages, or platform shutdowns.

12.3 DISPUTE RESOLUTION

The Parties agree to first attempt to resolve any dispute arising out of or relating to this Agreement through amicable negotiations.

If the dispute remains unresolved, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai, Tamil Nadu. The proceedings shall be conducted in English by a sole arbitrator appointed in accordance with the Act.

The arbitral award shall be final and binding upon the Parties.

Courts at Chennai shall have exclusive jurisdiction for the purpose of enforcement of the arbitral award.

13. Children’s Privacy

BLU ACADEMY recognizes the importance of protecting the privacy and personal data of children. In accordance with the provisions of the Digital Personal Data Protection Act, 2023, we do not knowingly collect, process, or store personal data relating to individuals under the age of eighteen (18) years without obtaining verifiable consent from a parent or lawful guardian.

Where our services involve individuals below the age of eighteen, such personal data shall only be processed upon obtaining appropriate consent from the child’s parent or legal guardian, and solely for lawful academic, administrative, or educational purposes related to the services offered by BLU ACADEMY.

If we become aware that personal data belonging to a child has been collected without the necessary parental or guardian consent, we will take reasonable steps to delete or restrict the processing of such information in accordance with applicable legal requirements.
